Rental agreement terms and conditions for Farniku car hire services.

These Terms of Service ("Terms") govern the use of the website farniku.com and all car rental services provided by Farniku ("Company", "we", "us", or "our"), a car rental operator registered under Philippine law and licensed by the Land Transportation Office (LTO) and Land Transportation Franchising and Regulatory Board (LTFRB).

By booking a vehicle or using our website, you ("Renter", "Customer", "you") agree to be bound by these Terms. If you do not agree, please do not use our services.

1. Eligibility to Rent

To rent a vehicle from Farniku, you must:

  • Be at least 23 years of age at the time of rental.
  • Hold a valid Philippine Driver's Licence or an International Driving Permit (IDP) recognised in the Philippines.
  • Have held a driving licence for at least 12 months.
  • Present a valid government-issued ID and the credit/debit card used for booking.

2. Booking and Confirmation

Bookings may be made via our website contact form, email, or by phone. A booking is confirmed only upon receipt of our written confirmation. We reserve the right to decline any booking at our discretion.

3. Rental Period

The rental period begins at the agreed pick-up date and time and ends upon return of the vehicle to the agreed location. Rentals are charged per day (24-hour period) or per calendar month, as selected at booking.

  • Late returns of up to 1 hour are charged at one hour of the daily rate.
  • Late returns exceeding 1 hour are charged at a full additional day's rate.

4. Pricing and Payment

All published prices are in Philippine Pesos (₱) and are inclusive of:

  • Collision Damage Waiver (CDW) insurance.
  • Third-Party Liability (TPL) insurance.
  • Unlimited mileage.
  • 24/7 roadside assistance.
  • One complimentary airport delivery within Metro Manila, Cebu, or Davao.

Prices are exclusive of fuel. The vehicle is provided with a full tank; the Renter is responsible for returning it with a full tank.

Accepted payment methods: cash (PHP), GCash, Maya, Visa, Mastercard, UnionPay.

5. Security Deposit

A fully refundable security deposit is required at the time of vehicle collection:

  • Economy / Compact: ₱5,000
  • SUV / MPV: ₱10,000
  • Business / Luxury: ₱25,000

The deposit will be refunded within 3–5 business days of satisfactory vehicle return, provided no damage, traffic violations, or outstanding charges exist.

6. Vehicle Use Restrictions

The Renter agrees that the vehicle shall not be:

  • Used for hire, commercial transport, or ride-hailing (e.g., Grab, Angkas).
  • Driven outside the Republic of the Philippines.
  • Driven by any person not listed as an authorised driver on the rental agreement.
  • Used for racing, off-road activities, or any illegal purpose.
  • Loaded beyond its stated passenger or cargo capacity.

7. Insurance and Liability

All rentals include CDW and TPL. In the event of an accident, fire, theft, or any damage to the vehicle, the Renter must:

  • Immediately notify Farniku's 24/7 hotline: +63 917 823 5541.
  • File a police report within 24 hours of any incident.
  • Not admit fault or make any payments to third parties without Farniku's written consent.

CDW does not cover: damage to tyres, rims, glass, or undercarriage; damage arising from DUI; damage caused by wilful misconduct or gross negligence.

8. Cancellation and Refund Policy

  • More than 24 hours before pick-up: Full refund of any pre-payment.
  • Less than 24 hours before pick-up: One day's rental charge applies.
  • No-show: Full booking amount forfeited.

Farniku reserves the right to cancel a booking due to vehicle unavailability, providing full refund and, where possible, an equivalent alternative vehicle.

9. Governing Law

These Terms are governed by the laws of the Republic of the Philippines. Any disputes shall be subject to the exclusive jurisdiction of the courts of Pasig City, Metro Manila.
